Plain-language note. This is a starter version, written to be easy to read.

These plain-language terms apply when you use this site or list your property with UpZoned™ (“UpZoned”, “we”, “us”). By submitting the property form or using the site, you agree to them.

Who we are

UpZoned helps owners of property in recently rezoned areas understand their options and, if they choose, be connected with vetted independent professionals such as realtors, lenders and developers. We are not a real-estate brokerage, lender, law firm or appraiser, and we do not provide legal, financial, tax or real-estate advice. Anything we share is general information only.

The information you give us, and your permission to use it

When you submit the property form, you give us permission to collect, store, use and share that information as described in these terms and our Privacy Policy. Specifically, you grant UpZoned a non-exclusive, royalty-free permission to use the information you provide and to disclose it to vetted partner professionals so they can contact you and present options; your contact details are shared with a professional once you are matched.

You confirm that the information you give us is accurate to the best of your knowledge, and that you are the owner of the property or are authorised to act for the owner. You agree that we, and the professionals we match you with, may contact you by email, phone or text about your property and your options. You can opt out or ask us to remove your details at any time (see Removing your details below).

No guarantees

We don’t guarantee any particular result — including that you’ll be matched, receive an offer, sell, refinance or build, or that any figure we show is correct. Estimated values, zoning notes, timelines and what a property “now allows” are indicative only, may be wrong or out of date, and are not appraisals, surveys or legal determinations. Always confirm zoning and value with the relevant authority and qualified professionals.

Independent professionals

Any professional we connect you with is independent and is not employed or controlled by UpZoned. We don’t guarantee their advice, services, conduct, fees or results, and any agreement you enter into is strictly between you and them.

Removing your details

You can ask us to stop contacting you and to remove your details at any time through our contact form (choose “Remove my details / privacy request”). We’ll act on your request in line with our Privacy Policy and applicable law. Information already shared with a matched professional may remain with them, subject to their own policies.

Acceptable use

You agree to use the site lawfully, to provide truthful information, not to infringe anyone else’s rights, and not to interfere with the operation or security of the site.

The service is provided “as is”

We provide the site and service “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, UpZoned is not liable for any indirect, incidental or consequential loss, or for the acts or omissions of third-party professionals. Where liability cannot be excluded, it is limited to the maximum extent the law allows. Some places don’t allow certain exclusions, so parts of this may not apply to you.

Covering certain claims

To the extent permitted by law, you agree to reimburse us for reasonable losses that arise from information you submit that is false, or that you were not authorised to provide.

Changes

We may update these terms from time to time; the “last updated” date above shows when. If you keep using the site after a change, you accept the updated terms.

Governing law

These terms are governed by the laws of [British Columbia, Canada], without regard to conflict-of-laws rules. Set this to match the entity that operates UpZoned.
